Landlord reluctant to agree for lease termination which is for a period of three years and now it's 1 and half year and asking us to wait for the remaining tenure of 1 and half years. As per the lease terms and conditions, either party can three months notice to terminate the agreement or vacate. The problem is snakes are coming in to the house and there are vacant plots on three sides of the building which is full of trees and plants and it's too dirty. There was a quarrel which happened as we are concerned about the security and safety as we have a little one at home. But the landlord and his wife came home and abused and hit my wife because of the quarrel which happened the previous day. We immediately called the police and they came home in ten minutes and asked not to fight and informed owner to return the deposit of eight lakhs and to take our written notice. The landlord ignored to sign and return the copy of written notice. Then we went to police station and gave written complaint and police called the landlord and got the written notice of 3 months signed and also recorded his response to our complaint and have it with them. What if he doesn't refund in 3 months?

Thanks for the response. One question I read from the online content that court won't consider unregistered agreement. So my three years lease agreement is signed by both the parties with witnesses and notarized by advocate. All the payments to landlord was through online transfer and have bank records. So will this this suffice to go ahead with the further steps if he doesn't return the deposit in 3 months?

Hey,
If he doesn't refund the amount then you will have to send a legal notice to him to recover the same.
