Builder cancelled unit unilaterally

We booked an under construction unit of a prominent builder in gurgaon in July 2021. The plan was initially under subvention scheme. We paid 15% of the entire amount and obtained a loan in nov 2021. However, due to some issue with the bank and builder, the project was not financed by the said bank. Had no communication from the builder for 4-5 months but finally BBA was registered in March 2022. In May, we were told, telephonically, that loan has to be applied from a different bank now. We again followed the steps and started the process of loan. Meanwhile, the builder started sending demand letters, followed by pre-cancellation letter and eventual cancellation. Our loan sanction letter came 3 days after their cutoff date. We have been fighting for last 4 months as we want the unit and this is fraud by the builder. What is the solution under RERA? Can we fight for the unit allotment or just a refund ?

You may file a complaint with RERA stating your grievance and you can ask for both, unit allotment or refund, there is no issue in that. The Court will look into that matter and according to the facts & circumstances, may grant you either of the two options.
