HC: Arbitration Under NHA Restricted To Independent Assessment Of Compensation

An arbitrator cannot act beyond the ambit of his reference; Allahabad HC ruled, holding that arbitration u/s 3-G(5) of NHA, 1956 is only restricted to assessing the reasonable amount of compensation and is certainly not proceeding to question compensation granted by lawful authority. The arbitrator is certainly not authorized with power to set aside or question an order passed by the competent authority, nor can nullify the order passed.

Delhi HC Adjourns Hearing Of Pleas On Same-Sex Marriages Till 20 April

HC of Delhi adjourned various pleas which hearing for petitions of same-sex marriages under HMA, SMA, & FMA to 20 April. The Govt has informed HC that it has prepared its reply to pleasing legal recognition of same-sex marriage. The Petition filed urged HC to issue a declaration of HMA does not distinguish between Homosexual & Heterosexual couples; the right of same-sex couples to marry should be recognized under said Act.

No SC Relief For Sterling Biotech On One-Time Settlement To Banks

The Supreme Court has rejected a plea seeking an extension of time till March 31 to complete the one-time settlement of dues owed by Gujarat-based Sterling Biotech Limited, facing a money-laundering probe — to a consortium of banks. A Bench of Justices R F Nariman and B R Gavai dismissed the SBL-owned Richmond Investments Ltd application, seeking relief.

NHRC Handicapped Without Chairperson, DG Investigation: PIL In SC

For the first time in the history of NHRC since its inception, the apex human rights watchdog of the country is at present, running without its full strength as it does not have a Chairperson, Acting Chairperson, two members and the Director-General of Investigation. This was claimed by noted human rights activist and Supreme Court lawyer Radhakanta Tripathy in a PIL filed in the Supreme Court.

Parental-Side Kin Can Inherit Property Of Hindu Widow: Apex Court

SC has said family members on the parental side of Hindu widow can’t be held to be ‘strangers’ & her property can devolve upon them under Hindu Succession Act. Referring to Section 15(1)(d) of the Act, a bench of Justices Bhushan and Reddy said the heirs of the father of a Hindu woman are covered under persons entitled to the succession of the property.
