Shop tenant has currently changed his business and given the place to franchise

Shop tenant has currently changed his business and given the place to franchise, doing business in JV without taking owner's permission. Tenant is old and has not even paid rent since months. Just wanted to know, is the above legal or can the tenant be penalized or given a notice to allow franchise to be done in the rented shop?

That depends on the lease agreement between the owner and tenant and whether there is an option of sub-letting. Other than that for non-payment of the rent by tenant you would have to issue a legal notice to the tenant to pay arrears within 7 days of receipt of notice, failing which you will initiate civil and criminal proceedings.

If the tenant is breaching the terms and conditions of the rent agreement then the owner can take action again them and ask them for penalities and to vacant the place. For more help reach me on 9794148274
