Purchase of Property from a NRI through registered GPA
I am planning to buy a property in Gurgaon from a NRI who has provided a registered GPA to one of their friend. I wanted to know following -
1. If such transactions are safe or not ? what are the precautions need to be taken during such transactions ?
2. Process of TDS deduction ? Straight forward TDS is ~22%, but broker and seller are saying they will furnish a Income tax certificate with reduced or NIL TDS%. Is this a legal way to reduce the TDS, will there be any implication on buyer for fraud in income tax certificate furnished by seller ?
