General Advice

J&K Govt. advertised certain posts in December, 2020. I applied under EWS catego

J&K Govt. advertised certain posts in December, 2020. I applied under EWS category. I had planned to obtain the certificate before the closing date for applications. However, the COVID and restrictions prevented and I could not obtain it upto the time, the applications were allowed to be submitted. The entire family was down with fever and fright. SO finally I got one in May, 2021. In the meantime, the results of the exam were released where my candidature has been mentioned as "With held- subject to consideration of EWS certificate by Recruitment Board" Well I was eligible in December, 2020 too and Infact in my family my elder sister had already EWS certificate at the time of notification of advertisement. Will the board consider it. I have represented explaining the circumstances (sickness+ covid). What is your opinion, Sir. Any specific rule, law, judgement, which can be quoted to get the much needed relief. The board is yet to take a final call on the results.

I am attaching excerpts from the notification: which read as under: (17) Important Instructions To Candidates: The candidates are advised to go through the requirements of educational qualification, age, etc. and satisfy themselves that they are eligible for the post(s). Copies of supporting documents will be sought at the time of Document Verification. When scrutiny is undertaken, if any claim made in the application is not found substantiated, the candidature will be cancelled and the Board’s decision shall be final and binding. Candidates seeking reservation benefits available for RBA/SC/ ST/ OSC/ EWS/PSP/ALC/IB must ensure that they are entitled to such reservation as per eligibility condition prescribed in this notice. They should also be in possession of the certificates in the prescribed format in support of their claim. My simple query is: In the extraordinary circumstances of Covid and when the movement and restrictions were galore, can that become a ground for not having been able to procure the certificate. The eligibility was there then, as the sister of the candidate was already in possession of the certificate at the time of making application. Can there be any precedent that courts may have allowed relaxation in certain cases, which can be quoted to get relief. Although, I have made a representation to the recruitment board explaining all the facts, yet can the board reject. If it be so, what is the remedy. regards Sachin
