Resignation on probation and notice period

Hi I am working with a company since july 2018 and currently am on probation for 6 months. I am resigning due to medical conditions and even after submitting medical reports i am asked to serve a notice period for 3 months. The offer letter does not state a different clause for the notice period on probation. Plus they have asked to either pay back salary of 3 months or serve a notice or waive off my unpaid salary for 1 month. Also they have detained my original marksheet. Need help thanks

Please see your letter of employment and any other document signed and or given to you at the time of appointment. Write an email to HR/ your company stating about the clause wrt resignation during probation period. If they still insist on a procedure which is contrary to your appointment letter, serve them a legal notice.
