I'm being denied maternity leave

My employer gave me 3 options- Resign, go on 3 months paid maternity and months unpaid medical leave which will be paid only once I join back on 1 jan and any extension would result in non payment of my paid maternity leave and termination of my job, or go on 3 months maternity leave. Since I'm pregnant with complications and was advised to go bed rest, I had requested my employer to give me an unpaid medical leave till 8 weeks before my delivery dat and then I can go on my maternity leave, and I was given the above options. None of them work, as I don't want to quit, I can't join back after 2 months of delivery and 3 option would require me to join back even before my delivery is due.

Hey,

That is against what the law provides for. You can issue a legal notice to them and also take help of the courts. They can't fire you for these reasons.

You can contact me on 7601090381 or advsanjaynarayandas@gmail.com for further queries or information.

Employer cannot impose any condition against the law. Kindly file a case before the labour court in order to not only get your job back if already sacked but also provide you with the maternity benefits that you are entitled to. In case you need a lawyer to file and get you a ruling in your favour feel free to contact me on my email - malitanmoy2017@gmail.com

Just go through this Act once- "THE MATERNITY BENEFIT ACT, 1961". It will clear each and every doubt of yours. For any further assistance, feel free to contact me on my e-mail "shubhampabbiadv@gmail.com"
