I have unpaid salaries from my last employer

I had left the services of my last organisation last end April 2020. I had pending salaries due since Nov 19 till April 2020. After I left them with the assurance that I would be paid the arrears in monthly instalments with regular staff salaries, nothing has been paid so far. Not even my leave encashment dues. My gratuity has been paid by the trust fund created for this purpose with Reliance. I had approached the labour commissioner with my grievance, but after a few meetings I was told that I may approach the labour court. I was working with the company as their group CFO for over 5 years and the company ran into severe financial crisis and defaulted to all the bankers for the last over 2 years. However the company is functional and paying salaries to staff every month although in arrears. How do I recover my dues?
