harassment of employees by employer/manager

In view of the judgement passed by Supreme Court :bench of Justice Swatanter Kumar & B.S.Chouhan in the Suo Moto case RE:Ramleela Maidan Incident DT:4/5.6.2011, can Right to sleep and right to privacy be considered as fundamental rights? If an employer/Manager calls his employees late at night(e.g. 3 am) and wants to discuss job related matters with them, or asks them to come to work late at night, can any legal action be taken against him on the basis of this judgement?
