Can Maternity leave be availed it is following long unpaid leave.

My wife works in SBI and is an permanent employee. She was on long unpaid leave for taking medical care of her ailing father. During this leave she conceived but could not inform the employer, however, she reported after completion of five months of delivery and for maternity leave with condonation. Employer is denying to approve the request staying that she didn't work for 80 days in last 12 months. Please advise that whether this 80 days clause is applicable on permanent employees or temporary employees or on both.
