I had file a SW complaint against a builder in 2015 for wrongly collecting MVAT

I had file a SW complaint against a builder in 2015 for wrongly collecting MVAT from me and not depositing in government treasury, sec, 406, 420. A police report was taken and statement of both the parties was submitted in the court. The case had reached the stage of evidence before charge in 2020 at the start of pandemic. I do want to pursue the case further due to lot of legal expenses compared to the amount of MVAT involved and also I am not sure of the outcome of the case. Will the case automatically be closed or have I to take steps for closure of the case? I will be thankful if you will give your expert opinion.
