since you are working in the company i would presume that there already had been a background check done earlier. if it is the case then the termination based on a criminal complaint during the course of employment will have to be based on the terms of the employment. having said that it is also important that if you are of the opinion that the charges against you are false and is a result of mala fide and vindictive prosecution then you are better advised to either get the proceeding quashed against you or in the alternative try to get discharged if the police indeed files a chargesheeet instead of an FRT against you.
