I want to start a startup without leaving my current company.

I am working as a CTO in a startup with less than 4 people. I have a startup idea in my mind and would like to work on that project in coming months. Workload is very less in my current job so I can manage both. I would like to work on my startup idea independently, separate from my current company. So what are the things I should know before proceeding. Am I bound legally to give a share to the current company, even though I spend my own money? If I use company office or not? Should I start it as a side project within current company and de-merge later in case I decide to leave this company?Do I need to get a contract signed by current company? If so, what are the things I must state in the contract so I am not bound to any liability in case I decide to leave current company and focus on my own project?
